1. SCOPE OF THIS PRIVACY POLICY

Forustt, LLC (“Forustt”) understands the importance of individual privacy and the security of personal information. This Privacy Policy (“Policy”) explains how we collect, use, process and disclose your information in conjunction with your access and use of our website, and related services (collectively, the “Forustt Platform”). Please understand that by visiting, accessing or using the Forustt Platform, you consent to the collection, use, processing and disclosure of your information as described in this Policy. IF YOU DO NOT AGREE WITH THIS POLICY, DO NOT ACCESS OR USE ANY PART OF THE SERVICE, REGISTER FOR AN ACCOUNT OR MAKE A PURCHASE THROUGH OUR CHECKOUT PROCESS. Beyond the Privacy Policy, your use of the Forustt Platform is also subject to the Terms of Service.

Please note, our online store is hosted on Shopify Inc. (online e-commerce platform) and we use a 3rd party consumer-to-consumer marketplace application programming interface or (API), Webkul. You understand and agree that the use of your information will be governed by the privacy policies of these third-party platforms and your settings on that platform. We encourage you to review the Shopify Privacy Policy and the Webkul Privacy Policy (which are incorporated by reference into this Policy).

2. PERSONAL INFORMATION WE COLLECT

Personal information you provide to us

Registration Information. When you sign up for a Forustt account, register to use the Forustt Platform, sign up for a promotion, event or notifications, we require certain information such as your first and last name, email address, and password.

Seller Account Information. If you sign up as a Seller on Forustt, we require certain information such as your first and last name, email address, password, address, phone number, etc. You may also create a Seller account using a social networking service, we will obtain basic information from your public profile. For example, if you sign up with a Facebook or Google account, we will obtain basic information like your name, gender, profile photo, etc. Once you’ve registered an account, you will be able to list items or make a purchase on the Forustt Platform.

Payment Method/Third Party Payment Processing. If you select an item for purchase through the Forustt Platform, your payment-related information, such as credit card or other financial information, is collected by PayPal on our behalf. PayPal is a Third-Party Service, and if you access or use PayPal’s services, please review the PayPal Privacy Policy (which is incorporated by reference into this Policy).

Communications. We may receive additional information from you in the event you contact us directly. If so, you may be required to provide, but not limited to, your name, email address, phone number, attachments, messages with specific content, or any other additional information should you choose to do so.

Personal Information We Collect When You Use the Service

Usage Information. We collect information about your interactions with the Forustt Platform to help us understand how you use the Forustt Platform and help us improve it. For example, the pages you visit or the content you view, the searches you conduct, purchases you make, the dates and times of your visits, and any other actions associated with the Forustt Platform.

Log Data and Device Information. Such as details about how you’ve used the Forustt Platform, IP address, access dates and times, device information, device event information, hardware and software information, and unique identifiers.

Cookies, Analytics, and Third-Party Technologies. We and our third-party partners collect information through the use of “cookies”, pixel tags, or similar technologies to understand how you move through the Forustt Platform and interact with Forustt marketing/advertisements, to learn what content is popular, and to save your preferences in order to provide a better user experience. Cookies are small text files that web servers store on your computer or smartphone; they are designed to store basic information and to help websites recognize your browser. Some cookies remain on your computer or device until you delete them. Others for example, like session ID cookies, expire when you close your browser. We may use both.

You should consult your web browser(s) to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of the Forustt Platform.

Personal Information We Collect from Third-Parties

Third-Party Services. If you choose to link the Forustt Platform to a third-party account, we may receive information about you, including your profile information and your photo, and your use of the third-party account. There are several different third-party providers that Forustt obtains information from in conjunction with the information we collect through the Forustt Platform. Forustt does not manage, control, or take part in how these third parties’ handle or process your Personal Information, which they provide to us. Those third-party websites may have privacy policies that differ from our privacy policy. We are not responsible for those websites, and recommend that you review and understand their policies. Please contact those websites directly if you have any questions about their privacy policies including the disclosure of your personal information to us or if you wish to limit the information available to us, you should visit the privacy settings of your third-party accounts to learn about your options.

Background Information. For the safety and protection of all Forustt Users of the Service, certain background information may be obtained. For Users of the Service in the United States, to the extent permitted by applicable laws, Forustt may obtain information from public records of criminal convictions or sex offender registrations. We may use your information, including your full name and date of birth, to obtain such records.

Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as demographic data, or information to help detect fraud and criminal activity, and combine it with information we have gathered from third-party service providers and/or partners. For example, we may receive background check results or fraud warnings from identity verification service providers for use in our fraud prevention, security investigation, and risk assessment efforts. We may receive information about you and your activities on and off the Forustt Platform, or about your experiences and interactions from our partners.

3. HOW WE USE THE INFORMATION WE COLLECT

Provide, Personalize, Develop and Improve the Forustt Platform. We may use your personal information to:

• Allow you access and use the Forustt Platform and to help facilitate transactions,
• Verify your identity and maintain your account, settings, and preferences,
• Allow you to communicate with other Users of the Service,
• Send you updates, security alerts, support messages, and other notifications,
• Perform data analytics, debug, and research,
• Review, Process, or handle insurance claims or similar claims,
• Enable additional services and programs with third parties, and
• Personalize and customize your experience based on your interactions with the Forustt Platform, your search and buy/sell history, your profile information and preferences, and other content you submit

Improve the safety and security of all Users of the Service. We may use your personal information to:

• Detect and prevent fraud, spam, abuse, security and safety incidents, and other harmful activities,
• Verify or authenticate information provided by you,
• Conduct fraud prevention, security investigations, and risk assessments,
• Conduct checks against databases and other information sources, including background checks,
• Resolve disputes with Users of the Service, including sharing information with your Buyer or Seller about disputes related to your role as a Buyer or Seller,
• Enforce our agreements with third parties,
• Comply with our legal obligations, law, respond to legal requests, prevent harm, and protect our rights (see section 4),
• Enforce this Privacy Policy and our Terms of Service, and
• Assess or evaluate your interactions with the Forustt Platform and information obtained from third parties.

Provide, Personalize, Evaluate, and Improve our Advertising and Marketing. We may use your personal information to:

• Send you promotional messages, marketing, advertising, and other information based on your preferences and social media advertising through social media platforms,
• Send, with your consent, promotional messages, marketing, advertising, and other information that may be of interest to you based on your preferences,
• Administer rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by Forustt or its third-party partners,
• Personalize, evaluate, and improve our advertising,
• Analyze characteristics and preferences to send you promotional messages, marketing, advertising, and other information that we think might be of interest to you.

4. HOW WE SHARE THE INFORMATION WE COLLECT

We do not share or otherwise disclose information we collect from or about you except as described below or otherwise disclosed to you at the time of the collection.

Content and Images that You Publish

The Service allows you to share Your Content to the Service that is publicly visible to others. The Content you share to the Service such as:

• Your public profile page, which includes your profile photo, first name, description, and city/state.
• Reviews, ratings, and other public feedback.
• Content in a community or discussion forum, blog, or social media post.
• Product Images that you list on the Forustt Platform

We may display these parts of your public profile and other content you make available to the public, and share on third-party sites, platforms, and apps. We may do this to drive traffic to Forustt, or otherwise promote our content and Service. We may use your content and/or images in our online and offline marketing campaigns, which may be conducted via third parties on our behalf, subject to the license  you give us to use such images and content as set out in our Terms of Service.

Payment and Transactions

If you deal with a Forustt Buyer or Seller, we may share your contact details with them. At times, this can be a necessary part of buying and selling and using our Service. If you buy something using our Service, your name, delivery/billing address, email address or phone number that you provide during checkout may be shared with the Seller for the purposes of your order. However, you should not share your details directly with Sellers and if something does not feel right or you have any concerns, you can contact us support@forustt.com

When you sell an item using our Service and receive the shipping label from Forustt, we share your name, address, email address and phone number with our shipping partner(s) for inclusion on the shipping label to provide the Service to you. 

At checkout you will be re-directed to PayPal for payment information.

Social Networks and Other Online Services

The Service may allow you to, upon your direction, share information with social networking services. You understand and agree that the use of your information by any social networking websites will be governed by the privacy policies of these third-party platforms and your settings on that platform. We encourage you to review their privacy policies.

Analytics Partners

We use analytics services such as Google Analytics to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. You can learn more about Google’s practices by visiting

We may disclose your information to law enforcement, government or public authorities, courts, tax authorities, authorized third parties, or other Users of the Service, if and to the extent we are required or permitted to do so by law or where disclosure is reasonably necessary to: (a) comply with our legal obligations, (b) comply with a valid legal request, such as a court order or subpoena or to respond to claims against Forustt, (c) respond to a valid legal request relating to a criminal investigation to address alleged or suspected illegal activity, or to respond to or address any other activity that may expose us, you, or any other of our Users to legal liability or (d)  protect your, our, or others’ rights, property, or safety. To avoid any doubt, the disclosure of your Personal Information may occur if you post any objectionable content on or through the Forustt Platform.

Vendors, Service Providers, Partners, and Affiliates

To support us in providing, promoting, and improving the Forsutt Platform, we may share personal information with vendors and service providers retained in connection with the provision of the Service. We may also share personal information with our partners and affiliates for any purpose described in this Privacy Policy.

Advertising Partners

We may use third-party advertising partners to send you ads that we think may interest you. Some of our advertising partners are Users of the Network Advertising Initiative (https://optout.networkadvertising.org) or the Digital Advertising Alliance (https://optout.aboutads.info). If you choose not to receive personalized ads, please visit their opt-out pages to learn about how you may opt out of receiving web-based personalized ads.

Business Transfers

We may sell, transfer or share some or all of our assets, including your Personal Information if Forustt undertakes or is involved in any merger, acquisition, bankruptcy, sale of assets, or insolvency event in connection with the consideration, negotiation, or completion of such transaction with another company.

 5. SECURITY MEASURES

We take reasonable measures to protect your Personal Information by continuously implementing and updating administrative and technical (i.e. Google reCAPTCHA, etc.). However, we can make no guarantees as to the security or privacy of your information, as no organization can guarantee perfect security.

6. THIRD-PARTY PARTNERS & LINKED SITES

Forustt or Users of the Service may link to other websites, products, or third-party services that we do not own or operate (“Linked Sites”). When you interact with these Linked Sites and choose to use their service, you are providing your information to them. We encourage you to exercise due diligence and read their privacy policies as your use of these services is subject to the privacy policies of those providers. This Privacy Policy does not apply to your activities on these Linked Sites or any information you provide to these third parties.

 7. STORING AND DELETING INFORMATION

Forustt may store your data profile, and other personal data for the time period in which you have an account. You may send Forustt a request to delete your account at any time and Forustt will delete your account upon your request. After the request, Forustt will then delete the data that is not required for purposes such as insurance, taxes, regulatory, or any legal obligations. Additionally, Forustt may also use this data for purposes such as fraud detection and prevention, as well as safety and security protection measures. While these measures are implemented for the protection of personal information, none are completely effective, and there is no guarantee that personal information will be safe from unauthorized or illegal activity, including third-party acts.  In the event of a User’s unsafe behavior or safety related incident, Forustt has the right to deactivate that User’s account and retain certain personal information to prevent that User from creating a new Forustt account in the future.  

Forustt may not always be able to delete a User’s account. For instance, if a User has an outstanding credit on the account or involved in a claim or dispute. Once the issue has been resolved, Forustt will then delete the account as described above.

8. YOUR RIGHTS & CHOICES

In certain circumstances providing Personal Information is optional. However, if you choose not to provide Personal Information that is needed to use some features of our Service, you may be unable to use those features. You can also contact us to request updates or corrections to your Personal Information.

9. CCPA

If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the ‘Right to Know’), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to exercise these rights, please contact us at support@forustt.com.

 10. CHILDREN’S PRIVACY

Forustt does not knowingly collect, store, or use Personal Information from children under 18 years of age. If you are under the age of 18, please do not submit any information through the Service or use the Service under any circumstances. There is no part of the Service directed to children. If you believe that a child may have provided Personal Information in violation of this Privacy Policy, then please contact us at support@forustt.com

 11. CHANGES TO THIS PRIVACY POLICY

Forustt may update this Privacy Policy at any time. If we make updates, the new Privacy Policy will be posted in place of the prior revision. The “last updated” date at the top of this Privacy Policy will also be updated to reflect any changes. Continued use of our services and the Forustt Platform after an update, constitutes consent to the updated revision to the extent permitted by law. We will notify Users of the Service through the Forustt Platform via an email communication.
